Leading Bird Translation™ is one of the operating platforms under Xi'an Leading Bird Cultural Communication Co., Ltd., hereinafter collectively referred to as Leading Bird Translation™.This agreement is voluntarily concluded by users registered on the Leading Bird Translation™ client and Leading Bird Translation™ in accordance with the Civil Code of the People's Republic of China and other relevant laws and regulations.

Production Materials: Refers to the text, images, audio, and video content files distributed to users by Leading Bird Translation™ that require precise translation/typesetting/voice-over/post-production in various languages.This includes all completed and incomplete manuscripts, content approved or not approved by Leading Bird Translation™, and all materials generated during the cooperation process.

Tasks: Refers to any activities related to precise translation/typesetting/voice-over/pre-production/post-production in various languages conducted by users on the Leading Bird Translation™ client and through online or offline communication via social software such as Enterprise WeChat (groups), QQ (groups), email exchanges, and postal correspondence.

◇I.Confirmation of Service Terms

1.The user confirms that before signing this agreement, they have fully read, understood, and accepted all the contents of this agreement.By clicking to confirm agreement or actually accepting the rights (or performing obligations) under this agreement, the user indicates that they understand and unconditionally comply with all the provisions of this agreement.

2.When the user uses various individual services of Leading Bird Translation™, the user agrees to the service terms of the individual service and various announcements and rules issued by Leading Bird Translation™ in that individual service (collectively referred to as "Individual Terms").In this case, the Individual Terms and these Service Terms simultaneously apply to the user.If there is a conflict between the Individual Terms and these Service Terms, the Individual Terms shall prevail within the scope of their application.

3.Leading Bird Translation™ has the right to modify these Service Terms and the Individual Terms when necessary by reasonable means such as issuing announcements on the webpage.Users should timely review and understand the modified content and consciously comply with these Service Terms and the relevant terms of the individual service when enjoying various individual services of Leading Bird Translation™.If the user continues to use the products and services involved in these Service Terms, it is deemed that they agree to the modified content.In case of any dispute, the latest terms shall prevail.If the user disagrees with the modified content, they have the right to stop using the products and services involved in these Service Terms.

◇ II.Account Registration and Activation of Translator Status

1.Service Prerequisites

    The user confirms that when completing the registration process or actually using the service in other ways permitted by the Leading Bird Translation™ client, they must be a natural person, legal person, or other organization with full civil rights capacity and behavior capacity appropriate to the civil activities they engagein.If the user does not have the aforementioned qualifications, please do not use the service.Otherwise, the user and their guardian shall bear all consequences, and the Leading Bird Translation™ client has the right to cancel (permanently freeze) the user's account and claim compensation from the user and their guardian.

    2.Account Registration

    (a) Users confirm that upon completing the registration process or actually using the services in any manner permitted by the Leading Bird Translation™ Client, they should be natural persons, legal entities, or other organizations with full civil rights capacity and the appropriate capacity for civil conduct. If the user does not possess the aforementioned qualifications, please do not use the services. Otherwise, the user and their guardian shall bear all consequences resulting from this, and the Leading Brid Translation™ Client reserves the right to cancel (permanently freeze) the user's account and seek compensation from the user and their guardian.

    (b) After completing the account registration and logging into the Leading Bird Translation™ client, the user fills in the necessary information to become a translator for Leading Bird Translation™, accepts the constraints of this agreement, and passes the language pair test to become a translator.

    (c)The user promises that all information and data (collectively referred to as "Information") provided during registration and use of the service are true and accurate, and the user will promptly maintain and update the information, especially the provided email address, contact phone number, contact address, mobile phone number, and other contact information, to ensure effective communication with Leading Bird Translation™.If the user cannot be contacted through the provided information, resulting in any loss or increased costs during the use of Leading Bird Translation™ services, the user shall bear all such consequences alone.Any loss or damage caused to Leading Bird Translation™ due to this shall also be fully borne by the user.If the user's information changes and needs updating, the user shall operate according to the requirements or website prompts of Leading Bird Translation™.

    3.The user hereby explicitly authorizes Leading Bird Translation™ to use the information upon successful account registration to facilitate the user's convenient use of various services provided by Leading Bird Translation™.If Leading Bird Translation™ finds that the registration information or production task content violates Chinese laws and regulations, it has the right to immediately terminate the service, retain relevant records, and report to the relevant authorities.

    4.If the user violates any provision of this agreement, causing disputes or being handled by competent national authorities, the user shall bear all responsibilities independently and compensate for any losses caused to Leading Bird Translation™ or any third party.

    5.Without authorization from the relevant rights holders, the user shall not register a Leading Bird Translation™ client account in the name of others or other organizations, nor use misleading account information for registration, including but not limited to names, avatars, or profiles that make people mistakenly believe that the account is associated with a certain social celebrity or organization.Any disputes, conflicts, or damages arising from this shall be fully borne by the user.

    6.The user promises not to use Leading Bird Translation™ directly or indirectly to engage in any behavior that violates Chinese laws and social ethics.Leading Bird Translation™ has the right to delete content that violates the above commitments.Leading Bird Translation™ has the right to review and supervise the user's usage.If the user violates any of the above regulations while using the Leading Bird Translation™ client, Leading Bird Translation™ or its authorized entity has the right to require the user to correct it or directly take all necessary measures (including but not limited to changing or deleting the content published by the user, suspending or terminating the user's right to use the Leading Bird Translation™ client) to mitigate the impact of the user's improper behavior.Leading Bird Translation™ reserves the right to claim compensation from the user for any damage caused to Leading Bird Translation™ or any third party due to this.

◇ III.User Rights and Obligations

1.The user is responsible for independently completing the projects assigned by Leading Bird Translation™ and must not violate laws or regulations or infringe on the legitimate rights and interests of others.The user shall not transfer the projects assigned by Leading Bird Translation™ to any third party.

2.The user is responsible for ensuring the professionalism of the service process and the accuracy of the work results.The user's service process must implement quality control, and the delivered work results should meet industry standards and norms as well as the requirements of Leading Bird Translation™.

3.The user promises to deliver work results that meet the quality standards of Leading Bird Translation™.If the delivered work results do not meet the quality standards of Leading Bird Translation™, the user shall modify them within the specified period until fully compliant as pointed out by Leading Bird Translation™.

4.The user is responsible for delivering work results on time.If any event occurs that affects or may affect the user's timely delivery, the user shall notify Leading Bird Translation™ within 2 hours of the event.After mutual agreement, a new delivery time can be arranged; otherwise, it will be considered as not delayed.

5.During the service process, the user is obliged to adjust and cooperate with the modification opinions and delivery times proposed by Leading Bird Translation™ for the user's phased work.

6.After delivering the work results as required by Leading Bird Translation™, the user has the right to request Leading Bird Translation™ to pay the corresponding remuneration as agreed.

◇ IV.Intellectual Property Ownership

1.The user confirms that all legal rights (including but not limited to intellectual property rights) contained in the work results delivered by the user are exclusively owned by Leading Bird Translation™.The user guarantees that the use of the work results delivered by the user will not infringe on the legitimate rights and interests of any third party.

2.Without the written consent of Leading Bird Translation™, the user shall not use, copy, disseminate, or otherwise dispose of the aforementioned results.

◇ V.Confidentiality Obligations

1.The user promises to strictly keep confidential the production materials they come into contact with during the task period.The user is responsible for properly keeping the materials provided by Leading Bird Translation™ (including but not limited to the original translation text, original comic text, original audio and video files, images, text information, etc.).If the materials provided by Leading Bird Translation™ are leaked due to improper keeping by the user or intentionally disclosed to any third party, the user shall bear all losses of Leading Bird Translation™, including direct and indirect losses.

2.After leaving this website or terminating the task, the user shall continue to fulfill the confidentiality obligations until the production materials have been legally disclosed or Leading Bird Translation™ has given written consent to lift the confidentiality obligations.

◇ VI.Account Security

1.The user is responsible for keeping the login name and password confidential and shall be responsible for all activities or behaviors that occur under the login name and password, including but not limited to information disclosure, posting information, online agreement to or submission of various rules and agreements, online renewal of agreements, or purchasing services.

2.The user agrees: If any unauthorized use of the user's login name and password or any other violation of confidentiality occurs, the user will immediately notify Leading Bird Translation™ and authorize Leading Bird Translation™ to synchronize this information with affiliated companies and partners; Ensure that the user exits the Leading Bird Translation™ client correctly at the end of each online session. Leading Bird Translation™ cannot and will not be responsible for any loss or damage resulting from the user's failure to comply with this agreement.The user understands that Leading Bird Translation™ needs reasonable time to take action on the user's request, and Leading Bird Translation™ is not responsible for any consequences, including but not limited to any loss of the user, that occur before taking action. Unless required by law or judicial decision and with the consent of Leading Bird Translation™, the user's login name and password shall not be transferred, rented, gifted, or inherited in any way, except for property rights related to the account. During the use of Leading Bird Translation™ client services, the user shall be responsible for their behavior in using Leading Bird Translation™ services and for any consequences arising from improper keeping of the login name and password or authorizing others to log in and use.The user shall bear full responsibility for any information published or disclosed by the user or the user's authorized entity through the Leading Bird Translation™ client and client services and any consequences arising therefrom.

3.The user can edit the account name, nickname, avatar, profile, and other account information in the registration information, but must comply with relevant management regulations and not contain illegal or harmful information.Relevant identity information, education background, profile, etc., should be true, and the user shall bear any legal responsibility arising from this.

◇VII.Breach of Contract Liability

1.If the user violates the provisions of this agreement by sharing, leaking, rewriting, or plagiarizing, Leading Bird Translation™ will take measures such as warnings, deleting tasks, restricting account use, or pursuing legal responsibility depending on the severity of the situation.

2.Platform Exemption: Under the premise of complying with this agreement,Leading Bird Translation™ is not responsible for any third-party losses caused by user behavior.
